These terms and conditions ("Terms") govern your use of the Kajabi Website Templates ("Templates") provided by Breanna Lee Co. ("Company"). By accessing, using and/or purchasing the Templates, you agree to the following Terms. 

1. Single and Personal Use Only: The Templates provided by the Company are intended for single use only. You are granted a non-exclusive, non-transferable license to use the Templates for your personal or business website. You must not copy, share, distribute, sublicense, or duplicate the Templates in any form, whether in whole or in part, to any third party without the express written consent of the Company.

2. No Returns or Refunds: Due to the digital nature of the products & immediate delivery, all digital products, including the Templates, are non-refundable. By purchasing and using the Templates, you acknowledge and agree that no returns or refunds will be provided, without any exceptions.

3. Compliance with Copyright Laws: By purchasing and using the Templates, you agree to abide by all copyright and trademark laws. You are responsible for ensuring that the elements used in your published website using the Template, such as images, fonts, icons, or any other copyrighted materials, do not infringe on any intellectual property rights of third parties. The Company does not warrant or represent that the use of the elements in the Templates will not infringe upon any third-party rights, the elements used in the Template are placeholders and were not created to be used in your final published web site. It is your responsibility to seek appropriate legal counsel to ensure compliance with copyright and trademark laws. 

4. Ownership: All designs, content, and intellectual property rights associated with the Templates are owned by Breanna Lee Co. The Templates are protected by copyright laws and other applicable intellectual property laws. You acknowledge and agree that you do not acquire any ownership rights or licenses to the Templates, except for the limited license granted to you under these Terms.

5. Compatibility and Separate Account Requirements: You understand and acknowledge that the Templates provided by the Company are designed specifically for use with both a Kajabi account and a Canva account. The Templates may require certain features or functionalities that are only available within the Kajabi and Canva platform. It is your responsibility to ensure that you have an active and compatible Kajabi account to utilize the Templates effectively and an active Canva account to make the appropriate design changes to the Template. Furthermore, you acknowledge that the cost of the Kajabi account and Canva account is separate from the cost of the Templates. The purchase of the Templates does not include any fees associated with obtaining or maintaining a Kajabi or Canva account. You are solely responsible for all costs, fees, and charges related to both your Kajabi and Canva account.

6. Support and Technical Assistance: The Company does not provide technical support or assistance for Kajabi or Canva Pro accounts. Any issues or inquiries related to your Kajabi or Canva Pro account should be directed to the respective support channels provided by Kajabi and Canva.

7. Disclaimer of Warranty: The Templates are provided "as is" without any warranties or representations, express or implied. The Company disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Templates will be error-free, uninterrupted, or free of viruses or other harmful components. If there is an issue with the Template the Company must be notified in writing and will provide a solution to the issue within a reasonable amount of time. Template issues do not include failure to follow direction or failure to understand the Kajabi or Canva platform.

8. Limitation of Liability: In no event shall the Company be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the use of the Templates. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if the Company has been advised of the possibility of such damages.

9. Modifications: The Company reserves the right to modify or discontinue the Templates at any time without prior notice. The Company shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Templates.

10. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Arizona, without regard to its conflict of law principles.

11. Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding the use of the Templates and supersede any prior or contemporaneous agreements, communications, or understandings, whether oral or written, relating to the subject matter herein.

     

     

     

     

    By purchasing and using the Templates, you acknowledge and agree to the separate requirements and costs associated with a Kajabi account and a Canva Pro account.
